We will aim to treat your data in the same way we would expect our own personal data to be treated, in particular we have no plans to make money off selling your personal data to anyone. By using any of Wattson Blue services (“Services”), namely, Wattson Blue mobile app, web app, coaches console, our website, or any other material provided to you by Wattson Blue or a member of our team, you agree to our Privacy Policy and Terms of Use.

If you choose to use our Services, then you will be agreeing to the collection and use of information in relation to this policy. The information that we collect is used for providing and improving our services. We will not knowingly use or share your information with anyone except as described in this policy.

We would like to encourage you to read the whole Privacy Policy, however, we have summarised the key points below:

    • We will not knowingly share your personal information with any third party without your explicit permission apart for the purposes described here.
    • We might share some of your personal information with third party services, e.g. to record how our users interact with the app to improve our services.
    • We may pool the information we collect from both you and about you from other services (such as Strava, Polar or Garmin).
    • We may share your information with third parties in some situations, such as in processing registration (e.g. if you sign up using Strava or Facebook), payment processing, or for administrative purposes.
    • If you have given us permission, we may share your information with your coaches and sponsors.
    • If we do share any information, we will ensure that we use encryption to communicate your data.
    • We do not provide medical or health advice, and our services must not be treated as such. You should always consult your doctor if you have any medical or health concerns, related or unrelated to our services.

If at any point you no longer wish to share your data with us and wish to withdraw your data, you can notify us at any time and we will take the necessary action to ensure this happens.

Training and Medical Disclaimer

Wattson Blue does not provide medical or health advice. Our services are not intended to be used as medical or health devices or for diagnosis, prevention or cure of any health issues. We recommend that you consult your doctor before taking on any significant exercise regime, and periodically visit your doctor for check-ups.

Wattson Blue uses text, images and graphics that are for informational purposes only and our advice is not to be a substitute for medical coaching or training judgement. If you have any concerns, you should not delay in contacting your doctor regarding any medical questions or conditions. As a health and lifestyle app, we do not provide or offer any medical advice, diagnosis or treatment.

We endeavour to provide a high level of performance training advice and information, however, athletic monitoring is complex and requires information from many sources and is very dependent on the individual. We do not take any responsibility for inaccuracies, omissions or for the correctness of any diagnosis based in whole or in part from use of Wattson Blue.

If you experience any medical difficulties, you should stop using Wattson Blue services and consult your doctor immediately. You should not use Wattson Blue services if you are in any doubt about any health effects it might have on you. We do not accept any responsibility for any problems that arise from the use of services provided by Wattson Blue.

Information Collection and Use

To increase the effectiveness of our service and to improve your experience, we may require you to provide us with certain personally identifiable information. This may include, but is not limited to Age, Gender, Date of Birth, and daily questionnaires that shall collect heart rate, exercise efforts (such as rate of perceived exertion and power). We may use your data, alongside data from other users, to improve the Services we provide you. All data and information that is collected may be retained by us and used as described in this privacy policy.

Moreover, if you have chosen to link other services to Wattson Blue (such as Strava, Polar, or Garmin), then we may also record personal data you share with these services. We may also share personally identifiable information with them. All external services have their own terms of service and privacy policy and we strongly advise you to review these terms and policies on their website.

Sharing of Team Information

We do not disclose non-public information to third parties about specific team activity, scores or trends, but your coach shall have access to this information if you have selected to do so. This will enable the aggregation of anonymised athlete information to create trends across the group. If you have chosen to only share your anonymised data with the coach, you should note that it may still be possible for the coach to trace back your personal data with reasonable certainty.

Security

Wattson Blue endeavours to protect your data. We will keep your data on secure servers, and aim to encrypt all communication to and from our servers, such that your data is reasonably safe from third party intervention. We shall take reasonable precautions to prevent unauthorised access and use of your personal data. However, there are always risks associated with providing personal data via technologies and no system is completely tamper or hacker proof, so we cannot guarantee its absolute security. We will inform you and the authorities within 72 hours of becoming aware of any such security breaches.

Log Data

Whenever you use our services, we may collect usage or crash data within our services and we may use third party services to collect such information from your phone, or other devices. This Log Data may include personally identifiable information, including but not limited to your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics. This enables us to optimise the service that we provide to you.

Cookies

Cookies are files with a small amount of data that are sent to your browser from the website that you visit and are stored on your devices internal memory. We may, directly or via third parties, store cookies in order to provide and improve our services (e.g. to allow you to log in to the coaches console). You should exit our web services immediately and delete all website data if you do not accept to the use of cookies.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Privacy Policy on this page. These changes are effective immediately after they are posted on this page for new users and will be effective for old users within 30 days.

Children’s Privacy

These Services do not address anyone under the age of 16. We do not knowingly collect personally identifiable information from children under 16. In the case we discover that a child under 16 has provided us with personal information without the explicit permission of a parent or guardian, we immediately delete this from our servers and prevent future access from this user. If you are aware of any user that is under the age of 16 using our services, please contact us.

Service Providers

We may employ third-party companies and individuals due to the following reasons:

  • To facilitate our services.
  • To provide our services on our behalf.
  • To perform Service-related services.
  • To assist us in analysing how our services are used.

As such, third parties may have access to your personal information. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated keep all this data secure and not to disclose or use the information for any other purpose. We will aim to sign non-disclosure agreements with third parties and where possible we will anonymise the data. However, it may still be possible to trace back this data to an individual.

Wattson Blue services are provided on an “as is” basis, and no warranty, either expressed or implied is given. Your use of our services is at your risk. We do not warrant that our services will meet your specific requirement or is compatible with any other services. Moreover, we do not guarantee that the service will be completely uninterrupted, timely, secure, valid or accurate. We do not guarantee that the services will meet your expectations or that any errors reported or observed will be corrected.

Termination of our services

We may choose to terminate your account at any time for any reason, in particular if we believe your use of Wattson Blue violates our privacy policy or terms of use. If we do so, and you have subscribed to Wattson Blue Premium, we will contact you to refund you for any remaining part of your subscription.

Email lists and subscriptions

If you sign up to any of our services, we will add you to our mailing lists, and we may email you from time to time with information about our services or new products and features. Any such email will generally have an unsubscribe link, however, you may also contact us. directly to make such requests.

Data requests

If you are a user of our services, you may email us. at any time to request a copy of the data we hold on you. You may also request for your account and data to be completely deleted from our services. We will aim to respond to any such requests within 2 weeks.

Governing Law and Jurisdiction

This Agreement and any dispute or claim relating to or connected with it (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales and the Parties submit to the exclusive jurisdiction of the High Court in London.
